These SMS Terms & Conditions (“SMS Terms”) apply to text messages (SMS/MMS) sent by or on behalf of Otogenetics Corporation (“Otogenetics,” “we,” “us”) to the mobile phone number you provide. By opting in to receive texts from us, you agree to these SMS Terms.

1) Program Description
Otogenetics may send text messages for customer care and service-related purposes, such as:
• Support conversations and responses to your inquiries
• Service notifications and updates (e.g., case/status updates, shipping/specimen coordination, portal/account assistance)
Depending on how you opt in, you may also choose to receive informational and/or promotional messages from Otogenetics. Any promotional program (if offered) will have a separate, clear opt-in.

We do not use SMS as a substitute for secure communications and we may limit the content included in text messages.

2) Consent / How You Opt In
You consent to receive SMS/MMS messages from Otogenetics when you opt in through one of our disclosed methods, which may include:
• Submitting an online form that includes an SMS consent statement and an unchecked checkbox you actively select;
• Signing a paper or electronic form/requisition that includes SMS consent language; and/or
• Initiating a text message conversation with Otogenetics where we respond only with relevant information.
We will send messages only after you have provided the appropriate consent for the applicable program. (Promotional messages, if offered, require express written consent.)

Consent is not a condition of purchase. You may opt out at any time (see Section 5).

3) Message Frequency
Message frequency varies based on your relationship with Otogenetics and the nature of your request or enrollment (e.g., support conversations may generate multiple messages, while notifications may be occasional). Where a recurring program is offered, we will disclose the expected frequency at the time you opt in.

4) Costs
Message and data rates may apply. Charges are billed by and payable to your mobile service provider.

5) Opt-Out (Stop)
You can opt out at any time by replying STOP to any message from Otogenetics. After you opt out, you will receive one final confirmation message that you have been unsubscribed, and then you will no longer receive text messages from that program unless you opt in again.

7) Supported Carriers / Delivery
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless service provider and is not guaranteed.

IMPORTANT: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. We may share information with service providers that help us deliver messages and operate our systems (e.g., messaging platform providers), but only as needed to provide the services and not for their own marketing.

9) Eligibility / Use Restrictions
You must be able to receive SMS/MMS at the mobile number you provide. You represent that you are the authorized user of that number or have permission to enroll it.
Do not use SMS to send us sensitive personal information unless specifically requested via a secure channel. For urgent matters, do not rely on text messaging—call us at +1 (855) 686-4363 or contact emergency services if applicable.

10) Changes to These SMS Terms
We may update these SMS Terms from time to time by posting a revised version on this page and updating the “Last Updated” date. Your continued participation in an SMS program after changes become effective constitutes your acceptance of the updated SMS Terms.
